The driver who hit Mary had a blood-alcohol level of 0.125 percent & also had marijuana in his system. A motorist with a blood-alcohol level of 0.08 percent is legally drunk in Pennsylvania.
This driver had been arrested TWICE before for drunken driving in Berks County, He was convicted once and acquitted after arrests in Cumru & South Heidelberg townships.
At the time of the fatal crash, # was on parole for a simple assault conviction in Exeter Township. He was sentenced to six to 23 months for that incident in March 2007.
